Charging Players Legally (law)

Post by MrGG »

Just a question,

One thing that I've always been curious with - when violence breaks out - has anyone known a case where the players have been charged under assault (police).

Just because its on the sporting arena does not charge the fact that it is strictly assault.

For example - what Hall did to Staker in the AFL. I wonder how he stands legally to charge Hall for criminal assault.

Does anyone know a case of this being done in the Amateur league? I'm always been bemused over how playing on a field means that you are not punishable by the full extent of the law system.

A few weeks ago someone from the collegiete league posted something about an incident and charges were being laid, but I never hear any more about it.

Didnt Duncan Fergusson (formerly of Everton) get charged for an incident when he was playing in Scotland?

Ai Mr X he did,

he nutted (Glasgow Kiss) an opponent off the ball (John McStay) and done time for it in Barlinnie!

He famously caught two thieves inside his house too, nat too far away from my dad's place
and his wife called the police, when they arrived both thieves were suffering from injuries that
kept them in hospital for many weeks, Big Dunc was ok

Good on him
The young boys said unto him....."go up baldhead, go up"......so he did, rose like a salmon and nodded the ball into the net......1 nil! :-)

On the Big Bad Bazza subject, Staker could have pressed charges but he said on the news after the incident that he wasn't going to. Any assault that occurs on the pitch is still punishable by the normal parameters of the law. The thing is, even if the attack was provoked by words the coppers probably wouldn't do anything anyway because they can't be bothered with the paper work  . I guess it all depends on the seriousness of the attack.

I seem to remember a case from the Country Football league (Aussie Rules) in Victoria making the Footy show not too long ago, about a guy getting locked up foran incident that occurred on the field.

In the coutry football league incident that you speak of, the guy received 3 matches from the tribunal for striking, but got 2 months in jail through the courts for assault.

leigh matthews was charged with assault after striking neville bruns

The 1985 season was Matthews' last. During the season his forearm struck Geelong player Neville Bruns in an off-the-ball incident, breaking Bruns' jaw. No report was laid because video review facilities were then unavailable. However, after much public outcry, the VFL launched an investigation and subsequently deregistered Matthews for four weeks. He was also charged by the police and fined $1000 - this was a major factor in his retirement. Matthews 332nd and final game was the 1985 Grand Final loss to Essendon.

Heard the other day that a soccer player in Sydney got 2 months jail and had to pay all medical and court costs for breaking an opponent's jaw. One punch and broken in a number of places.I don't think the guy who pressed assault charges was employed but you would think that if he was, then loss of wages could also be claimed. The thing to keep in mind is that the offender now permanently has a criminal record which could affect his future for a whole lot of things - new job applications, etc.

I cant remember where i saw it.
I cant remember when, or who it was.........
But a neutral spectator at an Aussie rules game,
happened to be a copper and took it upon
himself to arrest a guy for headbutt an opponent.

I dont think you get immunity because youre on the pitch.
Depends on who sees it and what the victim is prepared to do about it.
Same as on the street.
You may get assaulted but its up to you to press charges etc.
If a copper sees it on the street, he'll step in.

Off topic, but still kinda on topic......
Does anyone know if Tyson was charged for biting Holyfields ear?
And what about those all in baseball/ice hockey brawls in the US?
Do cops get involved there?

ice hockey is just an excuse to have a legalised brawl
the people love it and the cops love it , doubt the cops would do anything

baseball , fights? , lol , no one ever actually hits anyone
the cops might break it up, but only to take the players handbags off them so they can check them for little blue pills

 I once played against my brother in law and i was a sweeper and he was a striker, after one or two "dodgy" tackles he started to get a bit fired up  We went into half time 2-0 up and i was giving him stick all the way to the change room he mentioned "I'm sleeping with your sister to which a fight broke out and I made sure he wouldnt come out in the second half  The ref set both of us off and he was replaced up front by a young lad who ended up scoring three goals on my replacement :( A friend of his was a police officer and tried convincing him to press charges to which my sister told him "the day you press charges is the day i file for divorce" (as a joke of course) the morale to this story is no matter who what why when and where, assault is assault :!: and can be dealt with to the full extent of the law

Thats the biggest load of crap Ive ever heard.
If i had my jaw broken by someone punching me on the park, he would be charged - no question.
If it happened in the change room no one would even blink about having charges laid - so whats the difference?
Don"t talk about camaraderie on the pitch if the bloke had any he wouldn't have hit me :D
